US TSA legalizes Medical Marijuana and Cannabidiol (CBD) Products for Air Travel

The US Transportation Security Authority is now permitting medical marijuana and Cannabidiol (CBD) products to be carried on board the passenger planes in carry-on bags and checked-in bags. This latest update on this legalization can be found on its website in the “What can I bring” section.

This new change to the existing policy on carrying some types of medical marijuana on passenger planes was announced by the Transportation Security Authority Tuesday.

It needs to be stressed that possession of marijuana and certain cannabis infused products on passenger planes still remains illegal under the federal law. The concerned TSA officer at the screening check point is the final authority that decides what is legal to be permitted on air travel and it is the responsibility of the TSA as a whole to report any incidents of illegal possession of marijuana and cannabis infused products by the passengers as it is a violation of the federal law.

According to ABC 13 only those passengers with a valid license to use and possess the medical marijuana and CBD products will only be permitted by the TSA. There still is some obscurity in the legalities of carrying medical marijuana and CBD products on passenger planes and this must become clear in the days to come.

It’s worth noting that marijuana is deemed by the US FDA as a schedule 1 substance that is dangerous and doesn’t have any medical value.

NJ.com reports that the US TSA has made this change to its existing policy mainly because of two reasons 1) the FDA has approved an anti-seizure drug last year made from CBD that is derived from cannabis but doesn’t contain the psychoactive ingredient that gets people high and 2) President Trump signed a Farm bill (Agriculture Improvement Act of 2018) last year that legalizes the use of hemp products.
